I suggest that you click on the link in the above article "report" (second paragraph in red).  The title of the actual Migration Policy Institute (MPI) 71 page report is "The Deportation Dilemma: Reconciling Tough and Humane Enforcement".   

I find it interesting that the writer of this "VOXXI Griselda Nevarez" published by HP selected statistics from 71 pages of this original MPI report and presented them without naming the original title of the original MPI report "The Deportation Dilemma: Reconciling Tough and Humane Enforcement".  My guess is VOXXI and HP are not interested in reconciling tough and humane enforcement.

With that said click on the link again http://www.migrationpolicy.org/research/deportation-dilemma-reconciling-tough-humane-enforcement and at the top of that page click on "Funders".  You will see "MPI is funded primarily through research grants from foundations.  We also receive funding from organizations, U.S. and international government agencies, corporations, and individuals".

I see a possible conflict of interest when any non-profit organization receives funding from grants, US government agencies, US corporations and individuals and then reports on US migration.  I am also suspicious when the ex-Commissioner of INS (including immigration enforcement), Doris Meissner, writes migration articles for the MPI.

With that said I am also suspicious that MPI's most recent articles on NAFTA and CAFTA are from 2007.  MPI reports on migration issues yet its most current discussion about how NAFTA- exacerbated illegal immigration to the US is 10 years old?

Wrong-Doings On The Border Reflect Wrong-doings At The Top

From the above article: "Obama has directed the Department of Homeland Security to enforce immigration laws "more humanely," the White House said in March."

How about The White House demanding that the undocumenteds' corrupt  home governments treat their own citizens "more humanely" so that they do not have to cross the border illegally in order to work and survive? 

How about The White House treating US taxpayers "more humanely" by ending NAFTA, CAFTA and their pending TPP trade policies that simultaneously export American jobs and import Latin America's (and the world's) undocumented?

How about The White House admitting that it's crony border security industries "fighting" illegal immigration and illegal drugs are actually profit-driven charades that thrive on their own ineffectiveness?

Immigration corruption and abuse flow down hill from the White House to our southern border.  The wrong-doings that occur on our border merely reflect the wrong-doings at the top.  And to try and correct one without correcting the other is like a dog endlessly chasing its own tail.

Former U.S. Border Patrol Agent reported overtime pay abuse 30 years ago, concerns continue today

DHS overtime not properly documented, certified







Whistleblowers inside the Department of Homeland Security have come forward to describe chronic falsification of employee time cards within the federal agency.  One said his attempts to address the problem 30 years ago went unanswered.
"I turned myself in,” John Randolph, a former agent with U.S. Customs and Border Protection, said in an exclusive interview with The E.W. Scripps Company.  "It was a can of worms 30 years ago. You can imagine what it is now."
The “can of worms” Randolph describes is Administratively Uncontrollable Overtime -- an overtime pay program within the Department of Homeland Security.
In a report submitted to the White House last October, the federal Office of Special Counsel estimates misuse of overtime pay in six DHS offices, including Customs and Border Protection, cost taxpayers $8.7 million a year.
Randolph thinks that number is a lot bigger.
"Even at my safest, most generous estimations I think it’s over 100 million dollars a year,” he said.
Since the October report, the Office of Special Counsel has forwarded six additional cases to DHS for investigation, bringing the total number of offices involved to 12. In a hearing, Carolyn Lerner, special counsel of the OSC, described the $8.7 million as a “conservative estimate of the cost of overtime abuse” and the whistleblowers estimate the cost nationwide is likely to reach tens of millions of dollars annually.
Randolph joined the Border Patrol in 1979. After five years on the job, five years of lying about working overtime hours, he didn’t work, Randolph turned himself in.
“Border Patrol agents can and do abuse this system by lying about the amount of overtime that they work,” Randolph wrote in a letter to Border Patrol leadership in 1984.
After receiving the letter, federal investigators interviewed Randolph. It was determined he did misuse the overtime pay system. He was suspended for 30 days and had to pay $5,951.68 back to the government through payroll deductions, according to a letter from the Border Patrol.
Officially Randolph participated in “theft of property and falsification of time and attendance reports,” according to a letter from the Border Patrol. But, he was never charged with a crime.
"They fined me and they gave me some time off,” he said. “But if it was as egregious as they said it was, why didn't that patrol agent march me right down to the U.S. Attorney's office and prosecute me?”
In the letter from the Border Patrol, he was warned, future misconduct could result in “more severe disciplinary action,” due to the “seriousness” of the situation.
Systematic problem
Randolph spent 18 years at Border Patrol stations in California, eight in El Cajon and 10 in San Diego. He then went on to become an agent with U.S. Immigration and Customs Enforcement.
"I saw enough to make me question the whole system,” Randolph said.  "I'm not going to keep my mouth shut about it.  I didn't then and I'm not now."
There are more than 20,000 Border Patrol agents and more than 200,000 people working inside DHS.

Thirty years have passed since Randolph stepped forward and alerted the government about the AUO abuse taking place within CBP.
Attempts to reach CBP and DHS by phone and email were made by reporters at The E.W. Scripps Company. No response to the questions has been received.
While time has passed, recent reports and allegations point to a system-wide problem, one that has essentially withstood the test of time, indoctrinated to new agents from day one, according to Randolph.
"I think it’s in the culture of the Border Patrol,” he said. “If you don't work it, you still pencil it in."
This practice can sometimes add up to 25 percent of a paycheck, and according to Randolph and other whistleblowers, has become routine over the last generation. Sometimes it is even used as a perk when trying to recruit new employees.
In a May 2013 letter to the OSC, Jose Rafael Ducos-Bello, CBP chief program manager, wrote, employees “choose to pickpocket Uncle Sam of an estimated $200 million this fiscal year alone.” Bello is a 24-year veteran of government employment.
AUO is only meant to compensate workers for unanticipated, urgent work. It is similar to overtime pay some law enforcement agents may acquire. Situations like having to continue with the chase of a suspect or finishing up with an arrest.
But, as highlighted in the letter from Lerner, at least six cases of AUO pay abuse were reported to her office -- costing taxpayers an estimated $8.7 million annually.

“Such abuse of overtime pay is a violation of the public trust and a gross waste of scarce government funds,” Lerner said in the letter to the White House.
“We are probably, technically violating the letter of the law,” Shawn Moran, Vice President and Spokesperson for the National Border Patrol Council, said. “But, we are accomplishing the mission within the very bad framework we have to work with.” The National Border Patrol Council is a union that represents Border Patrol agents.
Moran said Congress and CBP leaders look the other way because there isn’t an alternative to pay Border Patrol agents for working overtime hours. He also said, he believes the AUO pay program is saving the government money and other options would be more expensive.
He describes a pay scale that is out of date and needs to be revamped to better suit the work the Border Patrol agents are doing. “It’s not that the work is not allowed,” Moran said. “We need a modified system.”
Four months ago, DHS suspended AUO for certain employees working in some agency headquarters, full-time training employees and employees who have improperly received the overtime payments in the past. Last fall, DHS stopped paying overtime to clerical and office workers.
Moran said a typical Border Patrol agent will work five 10 hour days with the last two hours of a shift being reserved as AUO hours.
“It has been going on since before the 1970’s,” he said. “Border Patrol agents have been told they will work this recurring overtime. The ones not working AUO are the exception to the rule.”
Other whistleblowers
In the October letter, Lerner outlined reported cases of AUO abuse:
  • In a CBP training facility in Georgia, one whistleblower claims $5 million was paid in a year for unworked overtime. Some of the pay went to 50 managers.
  • In an ICE headquarters office in Washington, D.C., a whistleblower said everyone in the office claimed 10 hours of overtime, every week.
  • Two whistleblowers at the CBP San Ysidro border station claim they see their colleagues write down an extra two hours of overtime that were never worked.
  • In Laredo, TX, AUO is being used for routine shift change activities.
  • Situation Room employees in Washington, D.C., claim to have worked two hours of overtime following their assigned shift 89 percent of the time.
Lerner describes most of the claimed overtime work by Situation Room employees as "administrative in nature, often consisting of Headquarters or local taskings" and does not qualify for AUO. Lerner said according to the whistleblower, sometimes the employees were “surfing the internet, watching sports and entertainment channels or taking care of personal matters.”

The CBP Office of Internal Affairs opened up its own investigation into the allegations of overtime abuse by Situation Room employees in Washington D.C. The allegations were confirmed.
According to an April 2013 letter to the OSC, numerous employees “regularly abuse the use of AUO” and the “Director and Assistant Director authorize and abet the improper use of AUO.” The investigation also revealed AUO was not properly documented or certified as required by regulation and policy.
That is not the first time, the internal affairs department at DHS and CBP has verified improper use of AUO overtime. A 2008 investigation came to the same conclusion: “the investigation revealed that AUO is not properly documented or certified as required by regulation and agency policy.”
In 2008, the reported abuse of AUO involved a CBP stations in Lynden and Blaine, Wash.
"We're sworn federal officers,” Randolph said. “We swear we're going to tell the truth, we're going to uphold the law and we go back to our station and lie about the overtime we're working.  That doesn't work for me."
Fixing the problem
No one, including Randolph, has been charged with a crime and no lawsuits have been filed. Through federal freedom of information laws, Scripps reporters have been trying to determine how much money has been illegally paid to DHS and CBP employees over the last 30 years. These requests were submitted six months ago and reporters are still waiting for a response.

During a hearing on the overtime abuse issues by the Senate Federal Workforce subcommittee in late January, Sen. Jon Tester, D-Mont. said,  "I think you can be assured that we're going to be watching this issue very closely and holding the leadership at DHS very much accountable."
At the time of the hearing, DHS acting Secretary Rand Beers had already ordered a department-wide review of how AUO is used. Just before the hearing, a decision was made to suspend AUO for certain DHS employees.
“I’ve been very troubled by the reports of overtime abuse at the Department of Homeland Security,” Sen. Rob Portman, R-Ohio, said in an email to Scripps reporters.  “I continue to demand that the department take steps to eliminate the abuse and prevent it from happening again.”
During the January hearing, Ron Vitiello, Deputy Chief with the Border Patrol, said "the Border Patrol takes its responsibility to be a good steward of taxpayer dollars very seriously. Misuse of government funds is not tolerated."
At the same hearing, Lerner, with the OSC, said “we're really pleased at the progress but there still hasn't been a directive issued to stop it. This is not a difficult issue … it’s against their own financial self interest for them to hold people accountable as supervisors because they're getting it as well."
AUO pay is available to federal employees across various agencies and each agency has some options on how to regulate it.
For some workers in CBP the suspension of the AUO program means a 25 percent pay cut, according to Moran. So far, the Office of Special Counsel has not received any reports of misusing AUO from offices outside of DHS.
Senators Tester and John McCain, R-Ariz., introduced a bill in November which would give Border Patrol agents three pay schedule options.
The bill would eliminate AUO and would allow Border Patrol agents to choose to work 80, 90 or 100 hours in a two-week period. Any hours worked between 80 and the number of hours they choose, would be paid to the employees as time and a half. Anything beyond the agreed number of hours would be paid to them as compensatory time off, Moran said.
The bill was also introduced in the House by Rep. Jason Chaffetx, R-Utah. The National Border Patrol Council has endorsed the proposal. Tester and McCain estimate the bill would save taxpayers $1 billion over the next decade.
“We believe it (the bill) is a solution,” Moran said. “And with the situation with AUO being abused in some areas, it just gives it more urgency.”
This bill was assigned to a congressional committee on Nov. 13, 2013, which will consider it before possibly sending it on to the House or Senate as a whole.
Moran said, he has been told to expect it to take one congressional term before it could pass, but he is confident it will move forward. “We hoped it would go to markup in March, but that didn’t happen,” he said. “We’re hoping to see some more movement.”
In a statement, a spokesperson from the Homeland Security and Governmental Affairs Committee said DHS is working to address the AUO abuse concerns:
“Chairman (Tom) Carper (D-Delaware) find(s) the reports that Administratively Uncontrollable Overtime may have been inappropriately used at the Department of Homeland Security concerning. He believes that taxpayer dollars must be spent more wisely, particularly as our nation continues to grapple with fiscal challenges. The Department and its components are working to examine and address these concerns. That being said, finding a solution to this problem is a shared responsibility between the Administration and Congress. Chairman Carper will continue to work with his colleagues on finding a legislative solution to this problem that recognizes the hard work done by our frontline personnel at the border while safeguarding the taxpayer’s hard earned dollars at the Department of Homeland Security and throughout the federal government.”
Randolph said, the AUO abuse is widespread and he thinks a complete systematic overhaul of the program is the only way to stop it.
"Theoretically everybody that's in that system has lied about it at some point,” he said. “It's no wonder that they do not take it on and tell the truth about it. Until they take care of the systemic lying, nothing is going to fix this."

As a retired US Border Patrol/INS/ICE agent, I have read and heard "simple" solutions to illegal immigration for some 36 years.   I think the vast majority of Americans fail to see that Washington economically conspires with the undocumenteds' home country elite to economically rape not only the undocumented, but US tax payers too.

Washington's Corrupt Profitization Of illegal Immigration and Immigration Reform

Both of Washington's immigration reform plans - "comprehensive" and "step by step" - are designed as tactical political camouflage of Washington's own system of profit/labor driven illegal immigration with ensuing "reform" which scams billions of "border security" US tax dollars for  crony border security corporations. 

Washington's own NAFTA, CAFTA and pending TPP are profit driven collusions between the economic elite in the US and the undocumenteds' home countries.  Of course when one group hoards  wealth it is at the expense and suffering of other groups from both inside and outside of that country.

Hard taxpayer reform costs - initially $46.3 billion dollars - are found in Section 6 "Comprehensive Reform Funding" (a)(2)(A).  For extra corrupt McCain pork, 200 million for Arizona Prosecutions (S.744 Section 6 (a)(3)(C)(2)(B)(i) referenced in 1104(a)(1).  But wait!  Another 200 million for Arizona's and FEMA "Operation Stonegarden" (S.744 Section 6 (a)(3)(C)(2)(B)(ii) referenced in Section 1104(b). 

Illegal immigration and immigration reform are vehicles by which the US and Undocumenteds' home country elite rake in corrupt and immoral immigration profits.  Billions in remittances head home to the undocumenteds' home country economies ever year.  Eight thousand undocumented died crossing the US/Mexican border since NAFTA's inception.  Profit from the undocumenteds' illegal labor requiring billions more in taxpayers'  "immigration reform" monies have become institutionalized by Washington's immigration and corporate profiteers.

US and foreign corporatists want the undocumented to keep coming illegally to the US in order to refresh their supply of laborers flowing north and flowing south.  They want to make it harder for the undocumented to cross the border in order to make sure that only the most motivated and physically fit people illegally make it through.  Otherwise they keep dangling their immigration reform carrot in front of the future undocumented who will - by the millions and despite the dangers - take the insidious leap across our southern border. 

They want Americans to keep believing - despite years of evidence to the contrary -  that "border security" and billons more in American tax dollars will solve the illegal immigration problem.

Are you willing to consider the similarities between illegal immigration enforcement and enforcement against illegal drugs?  Decades, billions of dollars, millions of undocumented, and hundreds of thousands of people jailed and deported while both problems have actually gotten worse.

Immigration Activists Make Two Major, Self-Defeating Mistakes

And these mistakes play right into Washington's insidious, decades-long illegal immigration hand.

One:  they ignore and disregard that mainstream Americans are also victims of the undocumenteds' illegal immigration.  Two:  they ignore and disregard that the Washington elite and their trade policies (NAFTA, CAFTA, and TPP) conspire with the undocumenteds' home country elite in order to cause  the very conditions (disparity in wealth and poverty) that pushed 11.2 million undocumented into the US.

I say Americans will not idly stand by and let this feigned immigration reform happen again.  We have had it (estamos hasta la madre tambien ) with over-crowded hospital emergency rooms, losses of jobs and unfair demographic changes to our home towns.

Many Americans blame you the undocumented for these unwelcomed changes to their lives.  Those of us who have taken the time to study this issue realize that blaming the undocumented also plays right into Washington's hand.  In other words, as long as the undocumented are blamed the real criminals (the bi-national - US and foreign) elite and their government shills who profit from cheap labor, remittances and immigration reform) will continue this horrendous, family separating, death causing immigration charade.      

Rebellion of immigration activists will cause the exact immigration effects that Washington desires i.e. their continued insidious system of profit/labor driven illegal immigration.

Immigration activists who selfishly demand their own immigration reform benefits without taking into consideration the suffering of millions of future US undocumented, thousands more border deaths and the actual American victims of illegal immigration are no different than their greedy bi-national abusers.

The truth will set us all free.

The media reposts that the DHS Secretary Johnson is "weighing" curbing deportations.  The "news" gives yet another spark of hope to one side and tons of anger to the other.  Meanwhile - each political party blames the other side as no real change will happen - again. 

Do you honestly believe that this "good (immigration) cop" "bad (immigration) cop" trick is designed for anything but to maintain Washington's and the undocumenteds' home countries elite's insidious status quo of profit/labor/remittance driven illegal immigration requiring an ensuing "immigration reform" bringing billons more in border security boodle to Washington's cronies?

DHS Secretary Johnson announcing that Washington is considering curbing deportations would be like the kingpins of the Sinaloa drug cartel announcing that they are weighing the idea of curbing their sales of illegal drugs.  Or like the US military industrial complex announcing that its leaders are considering curbing wars and the sales of weapons of war.

Washington's entire crony border security industrial complex depends upon illegal immigration, deportations and "immigration reform" as a means to continue its decades' long profit run.

Immigration reform is a charade that is pitched to US taxpayers as an effective fix for illegal immigration.  It is as if in American minds the simultaneous resetting of the 11.2 million undocumented number to zero and the US tax payer rip-off of 46.3 billion more in crony border security boodle will magically erase illegal immigration from these taxpayers' minds.    

Those magic numbers during Reagan's 1986 Amnesty were approximately 3 million undocumented and one billion border security dollars.  If Reagan's 1986 numbers jumped from 3 million to 11.2 million undocumented in 2014 and 1 billion to 46.3 billion border security dollars in 2014, what will they be 28 years from now?

Most Americans do not have the time to delve into Washington's illegal immigration and immigration reform policies and practices.  Most Americans trust Washington and trust that Washington has the true intention to fix "our" immigration problems. 

After working as a US Border Patrol/INS/ICE agent for 26 years and studying these subjects for another 9 years in retirement, I unequivocally say that in regards to illegal immigration and immigration reform polices and practices, Washington does not have US taxpayers'  best interests in mind. 

Despite what Washington politicians say and US laws to the contrary, large US corporations (agricultural, hotel/motel, food processing, construction etc.) use and profit from undocumented labor.  Combined with the need for labor, the undocumenteds' home countries (especially Mexico) depend upon billions in remittances being pumped back into their home economies to survive.

I will not support any immigration reform or reform activists who do not address poverty and Washington's economic relations with their home country governments as the root cause of illegal immigration.  To date I have not found one person to address this issue.

It is shameful to me that these undocumented people and their supporters selfishly demand that their immigration reform cases and deportations be rectified while they say not want their immigration reform cases and deportations rectified while they say not one word about the very conditions that pushed them here and will continue to cause millions more undocumented people to   suffer in their home countries.  Also they shamefully refuse to acknowledge or respect the hardships US citizens face because of their undocumented presence in the US.  

Two or more illegal immigration wrongs do not and never will make immigration reform right. 

In this specific sense these undocumented people and their supporters are no different than the US and home country economic elite who use them for cheap labor, home country remittances and billions of US tax dollars for "border security".  Both groups (the undocumented and the economic elite) greedily want what benefits themselves the most while they take no action or say not one word about how to stop the man-made poverty that will continually cause illegal immigration, border deaths, and Washington's next version of amnesty.

Do you find it interesting that the world's strongest military power can move tens of thousands of troops anywhere in the world on a moment's notice but can't fix its own immigration system?

We have been bamboozled.  By we I mean American taxpayers and all people for and against immigration reform. 

We have been led to believe that Washington can and will secure the border.  The truth is that they won't secure it in such a way that illegal immigration and illegal drugs are effectively controlled.  Why?  Because there is simply too much money being made and too many jobs dependent upon the 40+ year long illegal immigration and illegal drug "wars" - not workable fixes.  In addition NAFTA has tied our US economy so close to Mexico's that Washington will do nothing to offend their corrupt, cartel-run trading partner to the South. 

Anyone who thinks that America's large agricultural, food processing, hotel/motel, and construction industries are not dependent upon undocumented laborers is wrong.  Anyone who thinks Washington is serious about stopping undocumented laborers from coming to the US is wrong too. 

Sure they will beef up the border and make it more difficult for people to cross.  Yet that only separates the strongest and fastest from the rest.  The undocumented will continue to make it through, and some will die trying.

Illegal immigration is a self-made problem because Washington's own trade policies not only continue but exacerbate the disparity in wealth in the undocumenteds' home countries.  Meanwhile, US taxpayers suffer the continued costs and consequences:  billions for border security that does not reduce the long hospital emergency room lines, losses of jobs, and unfair demographic changes to US towns. 

The game is rigged and the US taxpayers are thrown under the immigration bus by their own politicians.

The elite who run the US and the undocumenteds' governments are greedy because they selfishly desire to use the undocumented to make more money off of the labor and remittances provided by the undocumented.

All those who hire the undocumented are greedy because they selfishly desire to save money by hiring the undocumented.

The undocumented who work in the US illegally are selfish because the selfishly desire to make more money by working in the US.

Washington's immigration reform politicians and their corporate border security cronies are greedy because they selfishly desire to make billions of US tax payers' dollars off of the border enforcement provisions of immigration reform.
 
The Mark Zuckerberg's of the US are greedy because they selfishly desire to pass immigration reform in order to make more money off of H-1b high tech foreign workers than US workers.

All People who benefit from immigration reform while turning their backs on the reasons why the undocumented come to the US i.e. poverty created by US and foreign government trade policies are greedy because they selfishly desire to make more money while ignoring that immigration reform will exacerbate the very reasons that the undocumented came here to begin with.  This includes the border deaths caused by illegal immigration.

All aspects of illegal immigration and immigration reform greed must be "brought out of the shadows" in order to stop the nightmare of illegal immigration.
